The Botswana Medicines Regulatory Authority (BoMRA) is mandated under the Medicines and Related Substances Act (MRSA), 2013 to regulate the manufacture, importation, distribution, sale and advertising of medicines and related substances including cosmetic products.
The Authority previously introduced voluntary listing of cosmetic products which is currently on-going. However, all stakeholders and the public are informed that the listing process will become mandatory from 1st April 2026 for all cosmetic products intended for the Botswana market.
- Purpose of Mandatory Listing;
- Enhance public health protection by ensuring only cosmetics meeting established safety, quality, and labelling standards are available on the market.
- Improve traceability and accountability through the designation of a Responsible Person for each listed product issuance of licensing & import permits.
- Align with international best practices, particularly the European Union Regulation (EC) No 1223/2009 on Cosmetic Products, widely recognized as a global benchmark.
- Generally, enhance regulatory oversight of cosmetics in Botswana
- Implementation
BoMRA will roll out the mandatory listing in the following phases:
- Stakeholder sensitization – Communication on mandatory listing
- Communication on stakeholder engagement date(s) that will be aimed at facilitation of the ongoing listing platform. Please note the listing portal is open at https://brims.bomra.co.bw/ for manufacturers, importers and distributors since 2023.
- Commencement of listing verification and enforcement of compliance for all products on the market from April 2026 going forward.
- The listing fees will be communicated in due time
- Key Listing Requirements (More details as per the listing platform);
All cosmetic products submitted for listing must meet the following criteria:
- Submission of product details via the BoMRA Cosmetics Listing Form (available at https://brims.bomra.co.bw/ )
- Labelled in accordance with the Cosmetics labelling guideline, including full ingredient disclosure and contact details of the Responsible Person
- No claims that would categorize the product as a medicine
The cosmetic ingredients should be in line with the EC1223/2009 regulation or the Botswana Standard BOS688 part 1&2.
- Enforcement
After the transition period, any cosmetic product found on the market that has not been listed with BoMRA will be subject to regulatory action, including seizure, product recall, and/or administrative penalties in line with the Act.
